We provide independent scientific evidence analysis to support medico-legal teams, expert witnesses, and insurers in complex healthcare-related disputes.


We work where scientific research meets legal reasoning, helping to clarify how clinical and biomedical evidence should be interpreted within medico-legal, insurance, and regulatory frameworks.


Our role is not clinical opinion and not advocacy. It is independent scientific analysis designed to complement expert evidence and support defensible decision-making.


HOW WE ADD VALUE


In medico-legal and clinical negligence cases, courts are increasingly engaging with the scientific basis of claims, not just the conclusions reached by experts.


Judges and opposing counsel are examining how disease mechanisms, progression pathways, and causal links are supported by the underlying research evidence, and whether the literature relied upon can legitimately sustain the inferences being drawn.


As a result, scientific assumptions that are not made explicit; or that extend beyond what the evidence can support, are more likely to be exposed through cross-examination and judicial scrutiny.


Expert witnesses are instructed to provide clinical opinion. They are not usually tasked with systematically interrogating the scientific literature itself, or with distinguishing clearly between established evidence, inference, and uncertainty.


Epistēmē exists to address this gap.


We examine the scientific foundations a case depends on, clarifying how research evidence aligns with the biological and causation assumptions being advanced, and where limitations or uncertainty remain.


This enables medico-legal teams and experts to engage with the science transparently, confidently, and in a manner that withstands scrutiny in court.

PRE-LITIGATION


At the earliest stage of a matter, we conduct targeted scientific literature reviews to assess whether the available evidence can plausibly support the biological and causation assumptions a proposed case depends on.


This includes examining:

  • disease mechanisms and progression,
  • assumed links between delay, exposure, or intervention and outcome,
  • the strength and limitations of the published literature being relied upon.
     

Early analysis helps inform whether a case is scientifically sustainable, supports proportionate case selection, and enables clearer expert instruction before costs escalate.

DURING PROCEEDINGS


Once expert witnesses are instructed, we work alongside medico-legal teams and experts to review how scientific evidence is cited, interpreted and applied within reports and arguments.


Our focus is on:

  • ensuring alignment between research evidence and the conclusions drawn from it,
  • clarifying where evidence supports opinion and where uncertainty remains,
  • strengthening the transparency and robustness of scientific reasoning within the case.
     

This work supports, rather than replaces, expert clinical opinion.
