HOW WE ADD VALUE
In medico-legal and clinical negligence cases, courts are increasingly engaging with the scientific basis of claims, not just the conclusions reached by experts.
Judges and opposing counsel are examining how disease mechanisms, progression pathways, and causal links are supported by the underlying research evidence, and whether the literature relied upon can legitimately sustain the inferences being drawn.
As a result, scientific assumptions that are not made explicit; or that extend beyond what the evidence can support, are more likely to be exposed through cross-examination and judicial scrutiny.
Expert witnesses are instructed to provide clinical opinion. They are not usually tasked with systematically interrogating the scientific literature itself, or with distinguishing clearly between established evidence, inference, and uncertainty.
Epistēmē exists to address this gap.
